Tutor Break service terms
By submitting a form, confirming a match or continuing to use the relevant service, you acknowledge these terms and the privacy notice. Important fees and timing will also be confirmed by message at matching.
1. Scope, definitions and consent
These terms apply to the student and the parent, guardian or payer who requests or accepts a Tutor Break match. If the student is under 18, a parent or legal guardian must approve the arrangement and is responsible for compliance.
Tutor Break organises approved public tutor information and assists with introductions. Tutors teach independently; Tutor Break is not a school, tutoring centre, employer, escrow service or guarantor of academic outcomes.
2. Accurate requirements and match confirmation
Provide truthful, current information about the curriculum, year, subjects, learning needs, district, schedule, lesson mode, budget and contact details. Disclose before confirmation any accessibility need, pet, building-access requirement or other circumstance that may affect a lesson.
Viewing a tutor profile or submitting a form does not book a lesson. A match is confirmed only when Tutor Break sends the proposed tutor and first-lesson arrangements and both sides accept them in writing.
3. Prepaid tuition and administration fee
Matching registration is free. To protect both sides and reserve the first lesson, the student/parent must complete the requested prepaid tuition no later than three days before the first lesson, using Tutor Break’s stated method. If payment is not received by the deadline, Tutor Break may withhold contact details or cancel the lesson.
Unless the confirmation message clearly states otherwise, the amount equal to the first lesson’s tuition is Tutor Break’s one-off administration fee and is not paid again to the tutor. From the second completed lesson onward, tuition is paid directly to the tutor. Amounts are in Hong Kong dollars unless stated otherwise.
If the first lesson cannot proceed or a refund is requested, contact Tutor Break promptly. We will consider the confirmation, notice given, whether teaching occurred, both sides’ records and applicable law. These terms do not restrict rights that cannot lawfully be excluded.
4. Sharing contact details and first contact
After prepaid tuition is confirmed, the student/parent authorises Tutor Break to give the selected tutor the student-side phone or WhatsApp contact solely for arranging lessons. This is normally provided two days before the first lesson.
The tutor is required to make first contact within 24 hours after receiving the contact. The student/parent should respond reasonably promptly and verify the date, time, duration, location or video link and agreed rate.
5. Changes during the first two weeks
If the student/parent needs to change a lesson during the first two weeks of a new match, both the tutor and Tutor Break must be notified at least 24 hours before that lesson. Otherwise, the lesson may be treated as having taken place and an additional amount equal to the prepaid tuition may be payable.
The student/parent may change the agreed lesson time once during the first two weeks of that match. For sudden illness or a reasonable emergency, contact both parties as soon as practicable; Tutor Break may consider documented circumstances case by case.
6. Attendance, conduct and safety
- Attend punctually and provide a safe, suitable in-person or online learning environment.
- For an in-person lesson with a minor, a parent or authorised adult must be reasonably contactable.
- Treat the tutor respectfully. Do not harass, discriminate, threaten, make improper demands or disclose private tutor information.
- Before recording, filming or taking screenshots, notify affected people and obtain consent required by law.
7. Cancellation, absence and ending lessons
After the first two weeks, both sides should follow the cancellation notice period agreed in their messages. Anyone who cannot attend must notify the other side as soon as possible and retain the message record.
Either side may end future lessons, but completed lessons and charges already expressly accepted remain payable. Safety concerns, fraud, harassment or serious misinformation should be reported to Tutor Break immediately.
8. Privacy and use of information
Student contact information is shared only with the selected tutor for matching and lesson coordination. It must not be used for unrelated marketing or disclosed to others. See the privacy notice for the website’s data practices.
9. Tutor choice, disputes and liability
The student/parent makes the final tutor choice and must check important information. Tutor Break does not guarantee tutor availability, lesson quality, a particular academic result, later direct payments or third-party platform availability.
To the extent permitted by law, Tutor Break is responsible only for reasonably foreseeable direct loss caused by a failure to exercise reasonable care in the matching administration. Nothing excludes liability that cannot lawfully be excluded.
10. Updates, governing law and contact
Material changes will show a new update date and normally apply to new use or new matches, not retrospectively to a confirmed fee arrangement. If one provision is unenforceable, the remaining provisions continue.
